These Terms & Conditions ("Terms") govern your use of the website located at this domain (the "Site") and your relationship with Pelican VR Arcade LLC ("Pelican VR Arcade," "we," "us," or "our"), operating at 1420 W 9 Mile Rd, Pensacola, FL 32534. By accessing this Site, making a booking, or visiting our physical location, you agree to be bound by these Terms. If you do not agree, please do not use the Site or our services.

## 1. Our Services

Pelican VR Arcade provides virtual reality gaming experiences, including individual game sessions, group and party bookings, and corporate event bookings. Details, availability, and pricing of our offerings are subject to change without notice.

## 2. Bookings & Payment

- All bookings made through the Site are subject to availability and confirmation by Pelican VR Arcade.

- Prices displayed on the Site are in U.S. dollars and are subject to applicable sales tax.

- Payment is processed through a third-party payment processor. We do not store full payment card details on our own servers.

- You are responsible for providing accurate contact and booking information. Pelican VR Arcade is not responsible for issues arising from inaccurate information provided by the customer.

## 3. Cancellations & Refunds

- Bookings may be cancelled or rescheduled up to 24 hours before the scheduled time for a full refund or credit, unless otherwise stated at the time of booking.

- Cancellations made less than 24 hours in advance, or failure to appear ("no-shows"), may be charged in full at our discretion.

- Refunds, where applicable, will be issued to the original method of payment within 5–10 business days.

- Special events, private parties, and group bookings may be subject to a separate deposit and cancellation policy communicated at the time of booking.

## 5. Assumption of Risk & Liability Waiver

Virtual reality gaming and related physical activities carry inherent risks, including but not limited to loss of balance, disorientation, motion sickness, collision with objects or other participants, and physical exertion. By booking a session or entering our premises, you acknowledge these risks and voluntarily assume full responsibility for any injury, loss, or damage that may result from participation, except where caused by our gross negligence or willful misconduct.

Guests under 18 years of age may only participate with the consent of, and supervision arrangements approved by, a parent or legal guardian, who must review and accept these Terms and any additional waiver on the minor's behalf before the session begins. We reserve the right to require a signed physical or digital waiver prior to any VR session.

Participants should disclose any relevant medical conditions (including but not limited to epilepsy, heart conditions, pregnancy, or balance disorders) to staff before beginning a session, as VR use is not recommended for all individuals.

## 6. User Conduct

When using the Site or visiting our premises, you agree not to: violate any applicable law; harass, threaten, or endanger any other guest or staff member; damage or misuse our property or equipment; or use the Site for any fraudulent or unauthorized purpose. We reserve the right to refuse service or remove any individual from our premises whose conduct we consider disruptive, unsafe, or unlawful.

## 7. Intellectual Property

All content on this Site — including text, graphics, logos, images, and the "Pelican VR Arcade" name and branding — is the property of Pelican VR Arcade LLC or its licensors and is protected by U.S. and international intellectual property laws. You may not reproduce, distribute, or create derivative works from this content without our prior written consent.

## 8. User-Generated Content & Social Media

By visiting our premises or participating in our promotions, you may be photographed or recorded (photo, video, or audio) as part of our normal business operations, contests, or events. Unless you notify a staff member in writing that you do not consent, you grant Pelican VR Arcade a non-exclusive, royalty-free, worldwide license to use such images or recordings, along with any content you tag, comment, or otherwise submit to us via social media (Instagram, Facebook, TikTok, Google, and similar platforms), for marketing and promotional purposes across our website, social media accounts, and advertising materials, without additional compensation to you.

If you submit reviews, comments, photos, or other content to us directly or via social media, you represent that you own or have the right to share that content, and you grant us the license described above to repost or feature it.
